中加法学交流项目组织师生赴司法机构参观访问

    汕头大学法学院-麦吉尔大学法学院法学交流项目近日组织参观活动,赴汕头市龙湖区人民法院、深圳金杜律师事务所、中国国际经济贸易仲裁委员会华南分会、东莞市第二人民法院等机构访问,深入了解中国的司法制度和其实际运作情况。参加参观活动的有加拿大麦吉尔大学研究生院副院长Rosalie Jukier教授、法学院院长助理Véronique Bélanger教授、汕头大学法学院副院长Michael Palmer教授、外事主任张勤副教授、外事秘书郑晶晶老师以及参加该项目的中加学生共25人。
 
    5月26日星期三上午,访问团一行赴龙湖区人民法院旁听了一起土地纠纷案件的审理情况。在庭审开始前龙湖区人民法院副院长,汕头大学1983级校友韦中铭先生会见了交流项目的中加师生,并和麦吉尔大学法学院代表互赠了礼物。上午庭审结束后,访问团师生和主审法官蔡肖文先生进行了座谈,从民事诉讼程序,到法官职业的自我评价和社会认同,再到法治和司法独立的关系等问题,师生们踊跃提问,气氛热烈。座谈会结束后,访问团驱车前往鸥汀街道司法所参观,受到司法所所长纪木荣先生等的热情接待。纪所长首先介绍了司法所的人员构成、人民调解委员会的设置、调解的主要纠纷类型等。麦吉尔大学法学院师生对被称为“东方之花”的人民调解制度表现出浓厚的兴趣,纷纷向纪所长和司法所其他工作人员提问,所交流的问题涉及到人民调解协议的效力、调解员的资格和待遇、人民调解和法院的关系等。
 
    6月2日星期三上午,访问团一行赴深圳、东莞参观访问,历时两天。2日下午访问了国内最大的律师事务所之一金杜律师事务所,事务所王主任和合伙人程雪玉先生、曹余辉先生接待了访问团一行并进行了座谈。座谈开始前王主任向大家介绍了金杜所的业务范围、合伙制所的运转模式等情况。在随后的座谈会上,访问团成员和金杜所部分律师就新律师的招聘、金杜所的成功秘诀、国际业务的拓展和国外律师实习安排等问题展开讨论,使大家受益匪浅。参观完金杜所,访问团访问了中国国际经济贸易仲裁委员会华南分会,受到了分会副秘书长刘晓春先生等的热情接待。刘晓春先生精彩幽默的演讲和介绍,给大家留下了深刻的影响,也把参观活动推向了高潮。
 
    6月3日星期四上午,访问团开始对东莞的访问。访问的第一站是位于长安镇的东莞市第二人民法院。东莞市第二人民法院成立于2009年1月,成立时间不长,但其创造的一系列调解和速裁制度受到了司法界和学术界的重视,涉及的调解类型包括诉前调解、诉调对接、立案调解、委托调解、协助调解等。在参观完法院的调解速裁中心后,陈葵院长主持了由访问团成员和法院部分法官参加的座谈会。座谈会涉及的主题有:调解速裁中心成立的动机和目的、人民调解员专职化趋势、交通事故纠纷的调解方法等。访问的第二站是松山湖科技产业园区。管委会科技教育局李伟民科长向大家介绍了产业园区的布局、产业分布、未来规划等。参加结束后,原东莞市人大副主任陈国辉先生在市政府接待中心宴请了访问团一行,东莞市人大法工委江流先生、市办公室副主任邓涛先生、外事局副局长谢玉华女士等参加了宴请活动。
 
    一系列参观活动是中加法学交流项目的组成部分,目的在于通过实地考察来深化对中国司法制度的了解,增进中加之间法律文化的理解和交流。汕头大学法学院-麦吉尔大学法学院法学交流项目历时两周,受到李嘉诚基金会的大力支持。
 
Recently Law school program between STU and McGill University paid a visit to the Judiciary, which covered Shantou Lake District People’s Court, Shenzhen King and Wood PRC Lawyers,South China Branch of China International Economic and Trade Arbitration Commission and the Second Dongguan People’s Court. Such an experience helped them learn more about China’s judicial system and its actual operation. Twenty-five Participants included Vice Dean of McGill University Graduate School Rosalie Jukier, Dean Assistant Véronique Bélanger, Vice Dean of STU Law School Michael Palmer, Director of Foreign Affairs Office Zhang Qin, Secretary for Foreign Affairs Zheng Jingjing and students.
 
On May 26 th Wednesday, the group headed to Shantou Lake District People’s Court and sit on the trial of land dispute case. Before the trial, Vice President of Shantou Lake District People’s Court, Wei Zhongming, a 1983 STU alumni, met McGill University faculty and students and exchanged gifts with representatives of McGill University Law School. After the hearing, there came a discussion with Chief Umpire Cai Xiaowen. They had a fervent exchange on various issues, like the civil proceedings, self-evaluation and social reorganization of judges, and the relationship between the rule of law and judicial independence. By the end of the discussion, their next destination was Ou Ting Street Justice. They were warmly received by Director of Justice Ji Murong. Director Ji introduced them the personnel component, people's mediation committee, and the main dispute mediation types etc.. Particularly, the people’s mediation system---“Flower of the Oriental” drew much of their attention. They raised many questions on the effectiveness of the mediation, mediators’ qualification and treatment, the relationship of people's mediation and the court.

Then that afternoon, the group of people hurried to Shenzhen and Dongguan for a two-day visit. The first stop is King and Wood PRC Lawyers, the largest Law Firm in China. Director Wang and the firm partners Cheng Xueyu and Cao Yuhui received them. Director Wang briefly introduced King and Wood PRC Lawyers, including its services and the operation mode of partnership. Later, they had a discussion in terms of issues, such as the recruitment of new lawyers, the key to the firm’s success, the international business expansion as well as lawyers’ internship in foreign countries, which benefited all present a lot. Leaving the law firm, they went to South China Branch of China International Economic and Trade Arbitration Commission, enthusiastically welcomed by Deputy General Secretary Liu Xiaochun. Mr. Liu marvelous presentation impressed the faculty and students so much, there appearing the climax of the activity.
 
On Thursday morning, June 3 rd, saw their visit to Dongguan. The Second Dongguan People’s Court was their first stay. Lying in Chang’an Town, the court has successfully gained much attention from the judiciary and academic circle due to its establishment of the mediation and efficient verdict system, though just founded in January 2009. Concerned mediation types covered before litigation, the joint of mediation and litigation, court mediation, conciliation commission and mediation assistant. What followed was an in-depth exchange between judges and the program participants. The exchange regarded issues on the motivation and objectives of the mediation center, the trend of professionalized mediators, methods of settling traffic accident disputes. The next stop was Dongguan Songshan Lake Sci. & Tech. Industry Park. Chief of CMC Technology Education Li Weiming introduced the park’s pattern, industrial distributions, and future planning. After that, former Dongguan Deputy Chairman Chen Guohui held a banquet for them. Mr. Jiang Liu from Dongguan Legislative Affairs Commission, Deputy Director of City Office Deng Tao and Deputy Secretary for Foreign Affairs Xie Yuhua also attended the banquet.
 
As part of the exchange program, the experience of visiting the judiciary served to have a better understanding of China’s judicial system and to enhance Sino-Canada exchange on law. The two-week program between STU and McGill University was fully supported by the Li Ka Shing Foundation.
